Terms of Service
These Terms govern your use of SoundAssist ("the Service"), operated by Andre Schrama from the Netherlands. By creating an account or using any part of the Service, you agree to these Terms.
If you don't agree, please don't use the Service. Questions: info@soundassist.online.
1. The Service
SoundAssist provides:
- A web platform for music producers and engineers to collaborate, share files, host live mix/master sessions, and showcase tracks on a public profile.
- Mixing and mastering services performed by professional engineers on tracks you upload.
- A desktop Connect app for Windows that mirrors the web platform's features (tracks, files, inbox, livefeed, groups) and captures audio from any application on your computer (DAW, DJ software, streaming services, browser) for real-time sessions.
2. Your account
2.1 Eligibility
You must be at least 16 years old to use the Service. By creating an account you confirm you meet this requirement.
2.2 Account security
You're responsible for keeping your password safe and for all activity under your account. Tell us immediately if you suspect unauthorised access.
2.3 One account per person
Sharing accounts is not allowed. Each user needs their own login.
3. Acceptable use
You agree NOT to:
- Upload content you don't own or have a licence to use.
- Upload content that is illegal, hateful, harassing, infringing, defamatory or that violates anyone's rights.
- Use the Service to send spam, malware or any kind of automated abuse.
- Reverse-engineer, scrape, or attempt to access parts of the Service you're not authorised for.
- Use the Service to compete with us (i.e. resell our services as your own).
- Interfere with the Service's operation, security, or other users' experience.
We reserve the right to suspend or terminate accounts that violate these rules, without refund where applicable.
4. Your content
4.1 You own your tracks
Anything you upload (masters, stems, mixes, voice messages, profile content) remains yours. We don't claim any ownership of your music or copyright.
4.2 What licence you grant us
You grant us a limited, non-exclusive licence to store, transmit, transcode (e.g. WAV → MP3 for streaming) and display your content only as needed to operate the Service for you. This licence ends when you delete the content or your account.
4.3 Public profile
If you make your profile public or mark tracks as public, the content you choose becomes visible to anyone with the URL. You can revoke that at any time by toggling visibility in your settings.
4.4 Master delivery
When an engineer delivers a master to you via the Service, the master file is yours to use. We don't retain ownership rights over the engineer's work product once delivered to and accepted by you.
5. Mastering + mixing services
5.1 Booking + payment
You book mastering, mixing, or stem-mastering services via the web app or our marketing site. Payment is taken upfront via Stripe. Prices include VAT where applicable.
5.2 Revisions
Each service includes a number of revisions specified at the time of booking. Once your purchased revisions are used, additional revisions may be billed separately at the rate listed in your dashboard.
5.3 Delivery timeline
We typically deliver mastered tracks within 24-72 hours of receiving the source files (excluding weekends). Complex projects may take longer; we'll communicate timelines upfront.
5.4 Refund policy
Because mastering is a custom service performed specifically for you, the EU right of withdrawal does not apply once we've started work (in accordance with Art. 16(c) Consumer Rights Directive, since digital content is being prepared at your request).
- Before we start: full refund within 14 days of purchase, provided no work has begun.
- After we start: not refundable. If you're unhappy with the result, we'll work with you under the revision policy (5.2) to make it right.
- Major errors on our side: if we deliver something fundamentally broken (wrong file, corrupted audio, etc.) we'll fix it or refund.
6. Subscriptions
6.1 Plans
Subscription plans (Artist, Engineer, Teacher, Studio) give you access to features like increased storage, AI transcripts, live session hosting, etc. Plan details are on our pricing page.
6.2 Billing cycle
Subscriptions renew monthly or yearly depending on the plan you chose. You're charged automatically at the start of each cycle.
6.3 Cancelling
You can cancel any time from your billing page. Cancellation takes effect at the end of the current billing period — no proration. You keep access until that end date.
6.4 Price changes
If we change prices, we'll email you at least 30 days before the change applies to your subscription. You can cancel before the new price takes effect.
7. Intellectual property (ours)
The SoundAssist name, logo, website, app code, and underlying technology are our intellectual property. You may use the Service for its intended purpose; you may not copy, modify, sublicence or create derivative works without permission.
8. Service availability
We aim for high uptime but don't guarantee 100%. Scheduled maintenance, third-party outages (Vercel, Supabase, Cloudflare, Stripe), and force majeure events may disrupt the Service from time to time. We'll communicate planned maintenance in advance when possible.
9. Liability
9.1 The Service is provided "as is"
To the maximum extent allowed by law, we provide the Service without warranties of any kind (merchantability, fitness for a particular purpose, non-infringement).
9.2 Limit of liability
Our total liability to you for any claim arising out of or relating to the Service is limited to the total amount you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect, consequential, or incidental damages (lost profits, lost data, business interruption).
9.3 Consumer rights preserved
Nothing in this section limits your statutory rights as a consumer under Dutch or EU law. If you're a consumer, the protections of the Dutch Civil Code apply on top of these Terms.
10. Termination
10.1 By you
Delete your account at any time from your settings, or email us. We'll remove your personal data within 30 days (subject to legal retention requirements — see Privacy Policy).
10.2 By us
We may suspend or terminate your account if you violate these Terms, fail to pay for a paid service, or use the Service in ways that risk harm to other users or the platform. We'll communicate the reason and give you a chance to fix the issue when reasonable.
11. Governing law + disputes
These Terms are governed by Dutch law. Disputes are subject to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands, unless mandatory consumer protection law assigns jurisdiction elsewhere.
For consumer disputes, the European Commission's Online Dispute Resolution platform is also available.
12. Changes to these Terms
We may update these Terms occasionally. Material changes will be announced via email or in-app banner at least 14 days before they take effect. Continued use of the Service after the change means you accept the new Terms.
